Mifflin Township approves Outrigger's data center near Mifflinville

The number that mattersMifflin Township's new ordinance requires data centers to stand at least 1,000 feet from homes, schools and parks, but only 350 feet where the setback would cross Interstate 80 (Ordinance 2026-5-11).
Developer
Outrigger Industrial Acquisitions, LLC, which appeared through attorneys at township meetings. Township records don't name its owners. Outrigger Industrial, a developer Indiana Public Media describes as based in Columbus, Ohio and co-founded by Steve Rowley, builds sites for end users such as hyperscalers. A broker listing for the Mifflinville site names Outrigger Industrial as Avison Young's partner, lists Steve Rowley as a contact and says the power agreement can be assigned by Outrigger, though township records still don't name the applicant's owners.
Tenant
No tenant or end user has been named.
Current stage
A reproduced public notice reports that supervisors granted conditional use approval on August 10, 2026, with a written decision dated September 4, and a broker listing from Avison Young in partnership with Outrigger Industrial says the conditional use permit covers a single 400,000 square foot building. The listing offers the site to buyers as about 68 acres (65 in its header) with 250 megawatts of grid power that it says PPL Electric Utilities has confirmed, available starting in 2029, and says an electric service agreement must be signed before December 23, 2026. The signed decision and its conditions haven't been retrieved, and DEP lists no state permit applications yet.
Decision body
Mifflin Township Board of Supervisors (Ricky Brown, Roger Mowery Jr. and Raymond Yachimowski Jr.) on the conditional use permit, with advice from the township Planning Commission; Columbia County Planning Commission review of the ordinance; Pennsylvania DEP Northcentral Regional Office for permits; Aqua and the Berwick Area Joint Sewer Authority on utility capacity.

water supply and sewer capacity; power use and brownouts; noise; setbacks from homes; building height; decommissioning; access to township correspondence with the developer
Key opponents
A citizens group took part in the May 11, 2026 ordinance talks through its own attorney, according to township minutes, which don't give the group's name. The township Planning Commission recommended against the first draft of the ordinance in March 2026. No group website or petition has been found.
Key supporters
Outrigger Industrial Acquisitions, LLC and the landowning family, both represented by attorneys at the May 11, 2026 meeting. No township official has publicly endorsed the project in posted records.

How we got here

On January 5, 2026 residents asked Mifflin Township supervisors about a rumored data center, and chairman Ricky Brown said the solicitor was drafting rules and nothing had been submitted. On February 9, 2026 solicitor James Brando presented a technological infrastructure ordinance, which supervisors sent to the Planning Commission. On March 3, 2026 the Planning Commission recommended against it. On April 13, 2026 supervisors took hours of public comment, questioned the developers and amended the draft with a 65-foot height cap, 1,000-foot setbacks and decommissioning rules, and the developers offered a $100,000 security. On May 11, 2026 supervisors adopted the ordinance after talks with attorneys for Outrigger, a citizens group and the landowning family. The Planning Commission held a conditional use hearing on Outrigger's application on July 7, 2026, and supervisors held theirs on August 10, 2026.

Know your rights

In Pennsylvania, the local zoning ordinance sets the route. A conditional use is decided by the elected governing body (supervisors, commissioners or council). A special exception or variance, and an appeal of a zoning officer’s decision, go to the Zoning Hearing Board. Each is a public hearing on a record: affected neighbors can ask for party status, cross-examine witnesses, and appeal. Municipalities can also adopt data center ordinances with enforceable standards.

Take action

Organized community opposition is the single most effective check on these projects in Pennsylvania. Show up to hearings, submit comment when it is taken, support legal and expert-witness costs, and press your municipality for a real ordinance. Pennsylvania municipalities cannot simply freeze applications, but a curative amendment under the Planning Code gives them a defined window to fix a defective ordinance.
